1 General information

1.1 These Terms and Conditions are applicable and binding on you when you participate in the Casino.

1.2 This page defines the terms and conditions which apply to all monies and bets accepted by the Casino and to all services offered by the Grand Casino Kursaal Bern AG on the website operated by it: https://www.7melons.ch

1.3 The Grand Casino Kursaal Bern AG, Kornhausstrasse 3, 3000 Bern 22 (hereinafter the "Casino") has a casino licence (licence no. [516-005/03]) and an extension of the licence (no. [516-005/03-01]) for Switzerland for the online execution of casino games in accordance with the applicable Money Gaming Act (BGS).

1.4 As a licensed online casino, the Casino is obliged to comply with all applicable laws and regulations regarding gambling (https://www.esbk.admin.ch/esbk/de/home/rechtsgrundlagen/gesetzgebung.html). The Casino is supervised by the Swiss Federal Gaming Commission (SFGB) (https://www.esbk.admin.ch/esbk/de/home.html).

1.5 For reasons of readability, the masculine form has been chosen in the text; nevertheless, the information refers to members of both sexes.

1.6 These Terms and Conditions supersede all pre-existing terms and conditions published on this Casino Website.

2 Object and validity of the GTC

2.1 These Terms and Conditions govern the terms and conditions for the use of online casino games, including their demo versions (hereinafter referred to as "Online Games" or "Game Offer") on the website http://www.7melons.ch/ and its sub-sites (hereinafter referred to as the "Casino Website") and on the Casino app 7 Melons (collectively the "Gaming Platform") operated by the Casino. The GTCs also govern the conditions for the use of the Casino's services associated with the offer of online games.

2.2 These GTCs are deemed to be accepted by the player as soon as he/she declares his/her agreement by clicking on the confirmation field provided for this purpose during registration.

2.3 The Casino is entitled to unilaterally amend these GTCs at any time. The casino will inform the player of the changes in a suitable form. The GTCs in force at the time of use of the game offer shall apply in each case.
In the event of significant changes or amendments ("Amendments") to regulations or to these GTCs that are to the detriment of the Player and that are not due to legal or official requirements, the Casino will again seek the Player's consent at the next log-in.

2.4 In addition to the GTC, rules of play apply to the individual online games, which are published by the Casino in an appropriate manner. By agreeing to these GTCs, the Player also undertakes to comply with the game rules binding for participation in the respective game.

3 Opening of the player account

Registration and identification

3.1 In order to use the gaming offer, a player account must be opened (Art. 47 VGS).

3.2 Only one player account may be opened per player. All Casino offers are intended for recreational players and we may, at our discretion, limit players' eligibility to play in any promotion. We reserve the right to withdraw the availability of any or all offers to players or groups of players.

3.3 A player account may be opened by anyone who is of legal age, has a residence or habitual abode in Switzerland and is not subject to a gaming ban (Art. 52 BGS).

3.4 In order to open a Provisional Player Account, the following information is mandatory: surname, first name, date of birth, gender, language, home or residence address and e-mail address. All information provided during registration must be correct and complete in all respects.

3.5 Within 30 days of registration, the Casino is obliged to verify the identity of the Player. Until the identity check is successful, the following restrictions apply to the Provisional Player Account:

  • Profits cannot be drawn;
  • the player's transfers may not exceed CHF 1'000.

3.6 If verification of the information provided is not possible within 30 days of registration, or the verification reveals that the information is incorrect, the Provisional Player Account will be deactivated. If a Provisional Player Account is deactivated for this reason, the Casino will only pay the Active Balance and no more than the sum of the deposited amounts (Art. 52 VGS).

3.7 The Casino requires proof of all registration details, which can be provided by

  • a copy of an official identity document (passport, identity card, driving licence);
  • an electronic proof of identity;
  • any other equivalent means approved by the competent supervisory authority.

3.8 The Casino shall be entitled at any time to request further documentation and information in order to verify, without limitation, the identity, age, place of residence or method of deposit used, the origin of the funds wagered by the Player at the Casino and/or to prove that the Player has sufficient funds to play for money.

3.9 The Grand Casino Kursaal Bern AG may request the following additional documents as proof of address/domicile as part of the due diligence:

  • Confirmation of residence by the municipality of residence;
  • Bank/post office account statement;
  • Electricity, water or landline bills that are not older than 3 months;
  • Information on bank details.

3.10 After a successful verification of the information provided during registration, the player account will be finally opened.

3.11 The Casino is entitled to verify the Player Account information at any time and to carry out checks based on the information provided during registration, in particular the creditworthiness or residence of the Player, also with the assistance of third parties (e.g. credit agencies such as Crif, Teledata or KYC Spider and GBG ID3global).

4 Games offered by the casino

4.1 The game offer includes all online games made available on the gaming platform in accordance with the applicable legislation as well as the demo versions of online games made available thereon.

4.2 The Casino is entitled to change the game offer and/or the rules of the game at any time in compliance with the legal requirements.

4.3 The casino shall be entitled to refuse access to the gaming platform or participation in an online game at any time without stating reasons (Art. 53 para. 1 lit. a BGS).

4.4 Access to the game offer may also be restricted or temporarily impossible for technical reasons.

5 Access data

5.1 In order to register, the player must select a user name and set a password. As the user name is publicly available, it should not allow any inference as to the identity of the player. It is also prohibited to use offensive, insulting, racist or otherwise unlawful user names. In the event of a breach of these rules, the Casino shall be entitled to refuse to open a Player Account or to close an already opened Player Account at its sole discretion.

5.2 The player is obliged to keep his access data (user name and password) secret and to protect them from access by unauthorised third parties.

5.3 If the Casino suspects that the Player Account is being used by a third party, the Casino shall have the right to block the relevant Player Account and retain any funds in it.

5.4 Upon registration, the player must specify one or more maximum values to which he wishes to limit losses. The player may adjust the maximum value at any time, the reduction will take effect immediately, an increase in the maximum value will take effect after 24 hours at the earliest (Art. 87 par. 2 and 4 VGS).

5.5 The player is obliged to keep his registration details up-to-date. Should the address, e-mail address, telephone number or other contact details or personal information change, these must be updated immediately via Customer Service. The Customer Service is available 24 hours a day, 7 days a week.

6 Deposits to the player account

6.1 The Player Account is maintained in CHF (Swiss Francs) and is funded by the Player's deposits, winnings and conversion of free game credits. The free gaming credits granted by the Casino are not part of the credit balance (Art. 50 VGS). The gaming credits belong to the Player personally and are not transferable.

6.2 The Casino reserves the right to set a maximum limit on the balance in the Player's account if the maximum balance is exceeded. It may transfer a balance in excess of the maximum balance to a payment account in the name of the Player.

6.3 All information required to deposit money into the Player Account will be made available on the Game Platform. The payment methods available may be adapted from time to time. It is the Player's own responsibility to keep himself/herself informed of changes in payment methods. A minimum amount of CHF 10.00 applies to deposits.

6.4 When using a credit or debit card for deposits, an authorisation will be carried out. In the event of approval and authorisation, the deposit amount will be credited to the Player Account. In the event that approval or authorisation is not given by the Card Issuer, the Player Account will not be credited.

6.5 If the player uses a credit card, the name of the cardholder must be the same as the name registered on the site at registration. If this is not the case, the Player Account will be deactivated. If a credit card is used, fees may be charged to the Player directly via the credit card.

6.6 No interest will be paid on balances in the Player Account and there is no possibility of overdrawing the Player Account. Furthermore, the Casino does not grant credit.

6.7 The player may only deposit money where he himself is the beneficial owner. He may not deposit money into the Player Account if he knows or must assume that it originates from criminal or illegal activities. Nor may he deposit money using a means of payment over which he has no right of disposal.

7 Payments from the player account

7.1 The player may at any time request that the active balance on the player account or part thereof be transferred to his payment account.

7.2 Pursuant to Art. 50 para. 2 VGS, winnings and credit balances in the Player Account may only be transferred to a payment account in the name of the holder of the Player Account. Withdrawals may be made with a time delay due to the identity verification process pursuant to Art. 15 -17 GwV-ESBK.

7.3 In accordance with Art. 45 of the Swiss Federal Law on Sport, players under the required minimum age, players who are banned from playing or who are subject to a ban on playing have no right to a refund of their stakes or to the payment of winnings. In such a case, the stakes remain with the casino, while any winnings are entirely earmarked for old-age, survivors' and disability insurance (Art. 45 BGS).

7.4 Illegally obtained player earnings are not paid out to the player but go to the AHV (Art. 56 BGS).

7.5 It is the sole responsibility of the Player to record and report relevant taxes on winnings.

8 Disbursement

8.1 Please note that any active balances will be saved and will be available at the next session.

8.2 Although we always endeavour to process withdrawals as quickly as possible, we draw your attention to the following factors which may affect the time frame for processing your payment.

8.3 The withdrawal process will start immediately after a player has requested a withdrawal. The Player has the option to reverse all or part of a withdrawal request within 24 hours of making the request ("Cancellation Period"), so that no further deposit is required. The Player has the option of contacting the Bank via chat to have all or part of his or her balance paid out immediately. 7 Melons reserves the right to refuse your request for cancellation at any time in its sole discretion. For the sake of simplicity, requested withdrawals initiated between 05.00 GMT on Thursday morning and 05.00 GMT on Sunday morning will remain pending in your account until after n05.00 GMT on Monday morning and may be reversed. Withdrawals will only be sent to our processing department after the withdrawal cancellation period has expired.

8.4 Not only do we comply with the guidelines of the "Financial Action Task Force on Money Laundering", but we also take strict security measures for your protection to ensure that you are the rightful recipients of your funds. In the event of a first-time withdrawal, a large withdrawal or a change of payment method, we may take additional security measures to ensure that you are the rightful recipient of the funds. In these cases, copies of identification documents may be required before payment can be made. These measures are designed to protect your money and privacy and may result in a slight delay.

8.5 Please ensure that all details provided by you for your withdrawal and account are correct. The Casino shall not be liable for any incorrect payments made as a result of incomplete, incorrect or fraudulent details. Fees: An administration fee of CHF 2 will be charged for payments under CHF 50. This will be deducted from your balance before payment.

9 Closure of the player account

9.1 A player account for which no registration and/or deregistration has been detected over a period of more than 2 years shall be closed by the Casino (Art. 51 VGS).

9.2 If the player no longer resides in Switzerland, or if he is affected by a gambling ban or a ban on playing, the Casino is legally obliged to prohibit the player from playing via the Account.

9.3 The player may also terminate or close his player account at any time. Termination or dissolution is only possible via the Customer Service.

9.4 In the event of a termination of the Player Account, any credit balance shall be transferred to a payment account in the name of the holder of the Player Account in accordance with Art. 51 VGS.

9.5 If the Player's Account details are not valid and the Casino is unable to contact the Player despite reasonable and proportionate efforts in relation to the amount involved, the Casino will hold the Player's funds for a period of two years. After this period, the credit balance is transferred to the AHV compensation fund (Art. 51 VGS). Any and all claims against the Casino shall thus be forfeited in full.

10 Blocking of the player account by the casino

10.1 The casino is entitled to block the player account at any time and without giving any reason (Art. 53 BGS). Any funds in the Player Account at the time of such blocking shall be transferred to a bank account in the name of the Player.

10.2 The Casino shall also be entitled to block the Player's account if there are reasonable grounds to suspect that the Player is misusing the gaming platform, that the Player is involved in money laundering, the financing of terrorism or the like, or that the funds deposited are of criminal origin or come from a criminal organisation, or if the Player makes false statements.

10.3 Abuse within the meaning of these GTCs occurs, for example, if the player integrates bots or bugs into software, uses other malicious software or other forms of artificial intelligence, regardless of whether the result of an online game has been changed or influenced by this.

10.4 In addition to blocking the player account, the Casino has the right to

  • withhold any disputed funds from being paid out to the Player, whether such disputed funds are deposits, refunds, bonuses, free money, casino credits, withdrawals or the like; and/or
  • define the criteria that the player must meet in order to open a new player account with the casino;
  • take further legal action.

11 Responsible gaming

11.1 The Casino takes its responsibilities and duties in the area of player protection and addiction prevention seriously and provides various tools and information on its website at https://www.7melons.ch/verantwortungsvolles-glucksspiel/ to control or limit problematic gaming behaviour.

11.2 In accordance with Art. 80 BGS, the casino is obliged to impose a gaming ban on players if there is a suspicion that the player is over-indebted, does not meet his financial obligations or makes gaming stakes that are disproportionate to his income and assets or if he receives a corresponding report from the competent authority or specialist agency (Art. 80 paras. 1 and 2 BGS).

11.3 The Casino may at any time require the Player to provide the information and documents necessary for the fulfilment of its legal obligations, in particular regarding the Player's financial circumstances. In addition, it is legally entitled and obliged to analyse the Player's transaction data and usage data.

11.4 The player may also choose, in accordance with Art. 89 VGS, to temporarily withdraw from one or more categories of games or from all games offered by the Organiser.

11.5 The player may not change the duration of the temporary suspension before its expiry. Upon justified request, the Organiser may cancel the temporary withdrawal if it has established that the conditions for a ban in accordance with Article 80 BGS are not met.

11.6 The ban on playing and a ban on gambling shall be entered in a Swiss national register.

12 Combating money laundering

12.1 The Casino is required by the strict laws on money laundering to report the Player to the federal or local authorities in that jurisdiction if it knows, suspects or has reason to believe that any transaction made by a Player involves funds derived from illegal activities or is intended to conceal funds derived from illegal activities or to use the Casino to disguise criminal activity.

12.2 In order to comply with anti-money laundering obligations, payment transactions (deposits and withdrawals) will be subject to verification to prevent money laundering or other types of fraudulent and/or criminal activity. The player is also obliged, at the request of the casino, to provide the beneficial owner, detailed information and documents relating to payment transactions and the origin of funds in connection with the player account (MLO-FBC).

12.3 If the Casino has knowledge or suspicion that the Player intends to engage in any of the foregoing, the Casino shall be entitled or obliged to take the following actions:

  • Immediately block the Player Account and/or, at its sole discretion, refuse to refund funds from that Player Account to the Player; and/or
  • pass on all relevant information about the player to an internal database which records these irregularities
  • refuse deposits or withdrawals and request additional verification requests and/or documents, such as in particular the origin of the funds deposited, proof of age and any other evidence to verify the identity of the Player

13 Bonus rules, offers & loyalty programme

13.1 Marketing

  • The casino can offer the player different offers.
  • For this purpose, the organiser shall determine the necessary criteria for players.
  • In order to avoid misunderstandings, we kindly ask you to observe the conditions applicable to the respective offer.

13.2 General free play rules

  • Once credited and activated by the player, free spins are valid and can be used at any time.
  • Winners can withdraw from the free spins if they do not wish to use them.

13.3 Weekly lucky draw

  • Players must accumulate at least 10 loyalty points in the previous week (e.g. 10 spins in a slot with a stake of CHF 5) to qualify for the weekly lucky draw, which takes place each Monday.
  • Players do not need to make an additional deposit to take advantage of the free spins won in the Weekly Lucky Draw offer.
  • Winnings from free spins are credited in real money and are not subject to a turnover condition.
  • A player has the opportunity to be drawn at the raffle and win the free spins a maximum of twice a month.
  • If a player rejects the free spins won, they are forfeited completely.
  • Winners will be selected at random.
  • There will be no correspondence about the lucky draw. Legal action is excluded.

13.4 Birthday offer

  • To qualify for the birthday offer, customers must have made at least one deposit before their birthday.
  • An additional deposit on the birthday is not required to receive the birthday offer.
  • Winnings from free spins are credited in real money and are not subject to a turnover condition.
  • A cash payment, a replacement and an exchange of the free spins are excluded.
  • If a player refuses the free spins received, they are forfeited completely.
  • If the free spins are not activated by the player within 7 days, they are forfeited completely.
  • The Casino reserves the right to terminate the offer without prior notice. Free spins received will remain valid until their normal expiry date (7 days after receipt).

13.5 Free spins

  • Players must have successfully verified their identity.
  • Players can participate in the "Free Spins" promotion a maximum of once a day.
  • Players do not need to make an additional deposit to take advantage of the "Free Spins" offer.
  • Winnings from the "Free Spins" are credited in cash money and are not subject to any turnover condition.
  • If the "Free Spins" are not activated by the player within 7 days, they are forfeited completely.
  • The "Free Spins" are given on Friday of each weekday.
  • The casino reserves the right to discontinue the "Free Spins" promotion on a weekly basis rather than every Friday.
  • A cash payment, a replacement as well as an exchange of the "free spins" are excluded.

13.6 Verification Free spins

  • Players must have registered and successfully passed the document check.
  • Players do not need to make an additional deposit to take advantage of the "Verification Free Spins" offer.
  • Winnings from the "Verification Free Spins" are credited in real money and are not subject to a turnover condition.
  • If the free spins are not activated by the player within 7 days, they are forfeited completely.
  • A cash payment, a replacement as well as an exchange of the "Verification Free Spins" are excluded.
  • The Casino reserves the right to terminate the offer without prior notice. Any "Verification Free Spins" already received will remain valid.
  • The casino is entitled to exclude players from the offer on the basis of responsible gaming.

13.7 Loyalty programme

  • The loyalty programme enables the player to collect loyalty points. Loyalty points can be converted into real money. For every 5000 points the player receives a real money balance of CHF 5.
  • On the first deposit the player receives 2500 loyalty points credited to the player account.
  • Loyalty points expire 60 days after receipt if they are not redeemed.
  • Further information can be viewed directly under the Loyalty Programme section in the player account.

13.8 General bonus rules

13.8.1 The bonus amount is subject to playthrough requirements and must be wagered 35 times before it is transferred from the bonus balance to the real money balance.

Example: If you deposit CHF 100 and receive a bonus of 100, the playthrough requirement is CHF 3,500 (100 x 35). All winnings generated by the real money portion of your balance can be withdrawn by you at any time.

13.8.2 When a bonus is credited to an account, the percentage of the bonus is calculated from the total balance. Each wager is deducted from the player's balance in the same proportion and winnings are credited to the player's balance in the same proportion.

Example 1: The player deposits CHF 100 and receives the welcome bonus of CHF 100. The account balance now consists of CHF 100 real money credit and CHF 100 bonus credit CHF - so the bonus percentage is 50%. The player wagers CHF 2, with CHF 1 coming from both the real money balance and the bonus balance. If the player loses the bet, the remaining amount is CHF 198 (CHF 99 real money credit and CHF 99 bonus credit).

Example 2: The player deposits CHF 100 and receives the welcome bonus of CHF 100. The account balance now consists of CHF 100 real money balance and CHF 100 bonus balance CHF. The player wagers CHF 2, CHF 1 is deducted from his real money balance and CHF 1 from his bonus balance. As a result, the player wins CHF 6. CHF 3 is added to the real money balance and CHF 3 to the bonus balance. The balance is now CHF 204 (CHF 99 real money credit + CHF 99 bonus credit + CHF 3 real money credit win + CHF 3 bonus credit win).

13.8.3. If the player makes further cash deposits before the existing bonus balance is used up, the ratio of real money stakes to bonus stakes will be recalculated.

Example: The calculation basis is CHF 100 real money balance, CHF 100 bonus balance and a bonus playthrough process of 3500 required for bonus balance realisation. The player decides to make a further deposit of CHF 10 with an account balance of CHF 10 real money balance and CHF 10 bonus balance and a bonus playthrough process of 3480 already achieved. The achieved bonus playthrough (3480) remains unchanged, the bonus playthrough required for bonus credit realisation (3500) also remains unchanged. The account balance is now CHF 20 real money credit and CHF 10 bonus credit. Based on the new percentage split of CHF 20 real money balance two thirds (66.66%) and CHF 10 bonus balance one third (33.33%), the stakes for the bonus playthrough process are recalculated. If a player now bets CHF 1, two thirds 66.66 centimes come from the real money balance and one third 33.33 centimes from the bonus balance. If a player wins CHF 1, the winnings are distributed as follows: 66.66 centimes are credited to the real money balance and one third = 33.33 centimes to the bonus balance.

13.8.4 Certain games contribute differently to the playthrough requirements:

100% All slot and keno games

8% All Table Poker, Roulette, Video/Power Poker (except All Aces and Jacks or Better Video Poker), All Blackjack (except Classic Blackjack) and Casino War

2% Classic Black Jack, all Aces Video Poker, all Jacks or Better Video Poker

0% All Baccarat, all Craps, Red Dog, Sic Bo games

13.8.5 If you do not want to use a bonus that has been credited to your account, you can contact customer service via email or live chat and cancel the bonus.

13.8.6 The casino is entitled to exclude players from bonus offers on the basis of social protection.

13.8.7 The casino reserves the right to terminate or change bonuses or offers at any time without notice. Offers that have already been activated remain valid.

13.8.8 Grand Casino Kursaal Bern AG reserves the right to block and close a player's account temporarily or permanently and without notice or compensation in the event of abuse of bonuses and offers of the casino.

13.8.9 If you make a withdrawal before the bonus turnover requirements have been met, the bonus credit awarded and any associated bonus winnings will be forfeited.

13.9 Welcome bonus

100% bonus up to a maximum of CHF 300 on the first deposit

All new players have 7 days from the day they account opening to claim their welcome bonus. After this period, the welcome bonus is no longer available, even if subsequent offers are available. The welcome bonus will then be considered forfeited.

The following general conditions apply:

 

  • This promotion cannot be combined with others.
  • The minimum deposit amount is CHF 10.
  • The welcome bonus is subject to the playthrough requirements as per point 13.8.1
  • This welcome bonus is only available once per player.
  • This offer is non-transferable. If you open multiple accounts, you are not entitled to the welcome bonus for each account.
  • A player opts for the welcome offer and then automatically receives a credit on the deposit.

13.10 Deposit bonus

100% bonus up to a maximum of CHF 200 on a second, third and fourth deposit of your choice

Existing customers are offered a maximum of three deposit bonuses after the bonus balance of the welcome bonus has been used up. The deposit bonus is valid for 3 independent deposits. A respective already accepted welcome or deposit bonus must be used up, the offers cannot be combined. A player can accept up to three times a 100% bonus up to a maximum amount of 200 CHF for one deposit. The player is free to choose whether to accept these deposit bonuses. The deposits are not limited in time.

The following general conditions apply:

  • This promotion cannot be combined with others.
  • The minimum deposit amount for this offer is CHF 10.
  • The bonus credit is subject to a turnover condition as per point 13.8.1.
  • The real money balance can be withdrawn by the user at any time.
  • When this bonus is activated, there is no specified time period in which the bonus must be wagered.
  • This offer is non-transferable. If you open multiple accounts, you are not entitled to the welcome bonus for each account.

14 General rules of the game

14.1 In addition to these Terms and Conditions, there are certain game rules which apply to Your participation at the Casino. You hereby agree to be bound by the aforementioned game rules as if they were an express part of these Terms and Conditions.

  • A detailed game manual is published directly in the game at a suitable and clearly visible location.
  • If a player has excluded himself from gambling, the winnings can be transferred to the player upon active request to our customer service.

14.2 The player may be offered daily offers such as free spins, loyalty points, etc.

14.3 The Casino reserves the right to reclaim any offer made and any accrued winnings if it is determined that the Player has tampered with or abused any aspect of the Casino offer. Where there is evidence of a series of bets placed by a Player or group of Players which, through increased payments under promotional offers, result in guaranteed Player winnings regardless of the outcome, we reserve the right to ignore the bonus element of such offers and settle bets using the correct odds.
