1 General

1.1. These Rules, Terms and Conditions apply to, and are binding upon you if you participate at the Casino.

1.2. This page defines the Terms and Conditions that apply to all monies and wagers accepted by the casino and all services offered by, and on the website powered by Grand Casino Kursaal Bern AG including the following website: https://www.7melons.ch

1.3. In Switzerland, Grand Casino Kursaal Bern AG, Kornhausstrasse 3, 3000 Bern 22 (hereinafter "Casino") has a gaming licence (licence no. [516-005/03]) as well as a supplemental licence (no. [516-005/03-01]) for providing online games under the applicable Gaming Act (Geldspielgesetz [BGS]).

1.4 As a licensed online gaming provider, the Casino is obliged to comply with the applicable laws and regulations on gaming,(https://www.esbk.admin.ch/esbk/de/home/rechtsgrundlagen/gesetzgebung.html). The Casino is supervised by the Swiss Federal Gaming Board (ESBK, https://www.esbk.admin.ch/esbk/de/home.html)

1.5 In order to facilitate legibility, the following text uses male forms. Nevertheless, the information refers to members of both sexes.

1.6 These Rules, Terms and Conditions replace any pre-existing Rules, Terms and Conditions that appeared on this Casino Website.

2 Subject matter and validity of the GTC

2.1 These General Terms and Conditions govern the terms and conditions of use of online games including their demo versions (hereafter "online gaming" or "gaming offers") on the website http://www.7melons.ch and on its subpages (hereafter "Casino website") and on the Casino App 7 Melons (collectively the "gaming platform") operated by the Casino. The GTC further set out the terms and conditions of use of the Casino's services connected with the offer of online games.

2.2 These GTC are deemed accepted by the gamer who gives his consent by clicking on the relevant confirmation field upon registering.

2.3 The Casino is entitled to change these GTC unilaterally at any time. The Casino will inform the gamer of any changes in an appropriate form. The GTC valid at the time of use of the gaming offer will apply. In the event of material amendments or add to (“changes”) to regulations or to these rules, terms and conditions, which operate to the gamer's disadvantage and are not required by law or official, the Casino will obtain the gamer's consent again at the next login.
The current version of the GTC may be downloaded and printed from the website http://www.7melons.ch at any time.

2.4 In addition to the GTC, the game rules which are published by the Casino in an appropriate manner for the individual online games, apply. By agreeing to these GTC, the gamer undertakes to comply with the game rules which are mandatory for game participation.

3 Opening of the gamers account

Registration and Identification

3.1 A gamer account must be opened in order to access the gaming offers (art. 47 VGS).

3.2 Only one gamer account may be opened per gamer. All casino offers are intended for recreational players and we may in our sole discretion limit the eligibility of Players to participate in any promotion. We reserve the right to withdraw the availability of any offer or all offers to any Player or group of Players.

3.3 Any person aged at least 18 years, having their domicile or habitual residence in Switzerland, who is not subject to a game ban (art. 52 BGS) may open a gamer account.

3.4 The following information is mandatory for opening a provisional player account: surname, first name, date of birth, gender, language, address of residence or domicile and e-mail address. All information provided during registration must be correct and complete in all respects.

3.5 Within 30 days of registration, the Casino must verify the gamer's identity. Until the authentication is carried through successfully, the following restrictions apply to the temporary gamer account:

  • wins cannot be collected;
  • the gamer's deposit may not exceed CHF 1,000.

3.6 If the declared information cannot be verified within 30 days of registration or if the verification reveals that the information is false, the provisional gamer account will be de-activated. If a temporary gamer account is de-activated for this reason, the Casino will only pay the balance and no more than the value of the deposits (art. 52 VGS).

3.7 We will require verification of all registration details and can be submitted by means of the following documents.

  • a copy of an official identity document (passport, identity card, driving license);
  • an electronic identity document;
  • any other proof of identity allowed by the competent supervisory authority.

3.8 The Casino is entitled to request additional documents and information at any time in order to verify, without limitation, the identity, age, domicile or method used to make the deposit and the origin of the funds used by the gamer in the Casino and/or evidence that the gamer has sufficient financial resources for gambling.

3.9 The Grand Casino Kursaal Bern AG may request the following additional documents for proof of address/domicile as part of due diligence.

  • Confirmation of domicile from the community of residence;
  • bank/post office account statement;
  • Electricity, water or landline bills not older than 3 months;
  • bank account details.

3.10 After a successful review of the information provided on registration, the gamer account is opened.

3.11 The Casino may verify the gamer account information at any time and, on the basis of the information provided on registration, carry out checks in particular on the gamer's creditworthiness or domicile address, also with the help of third parties (e.g. credit agencies such as Crif, Teledata or KYC Spider and GBG ID3global).

4 Games offered by the Casino

4.1 The gaming offers include all online games made available on the gaming platform in accordance with applicable legislation as well as the equally available demo versions of online games.

4.2 The Casino is entitled to change the gaming offers and/or the game rules at any time, within legal requirements.

4.3 The Casino may refuse access to or participation in an online game at anytime without stating reasons (art.53 (1) (a) BGS).

4.4 Furthermore, access to the game offering may be restricted or temporarily impossible for technical reasons.

5 Access Data

5.1 To register, the gamer needs to select a username and to set a password. As the username is publicly accessible, it should not allow any conclusions as to the gamer's identity. Offensive, insulting, racist or otherwise illegal user names are forbidden. In the event of a breach of these rules, the Casino has sole discretion to refuse to open a gamer account or to close a previously opened gamer account.

5.2 The gamer must keep his access data (username and password) secret and protect them from access by unauthorised third parties.

5.3 If the Casino suspects that the gamer account is being used by a third party, the Casino has the right to suspend the relevant account and to retain any funds in it.

5.4 When registering, the gamer must set one or more maximum values to which he wishes to limit his losses. The gamer may adjust the maximum value at any time, a reduction will become effective immediately, and an increase in the maximum value will become effective no earlier than 24 hours (cf. art. 87 (2) and (4) VGS).

5.5 The gamer is required to keep his registration details up-to-date. If the gamer's postal address, email address, telephone number or other contact details or personal information change, these must be updated immediately via the customer service. The customer service is available around the clock 7 days a week.

6 Payments to the gamers account

6.1 The gamer's deposits, wins and the conversions of free game credits are added to the gamer's account which is held in CHF (Swiss francs). The free game credit granted by the Casino is not included in the asset balance (art. 50 VGS). The gaming balance belongs to the gamer personally and is not transferable.

6.2 The casino reserves the right to set a maximum limit on the gamer’s account balance in the event whereby the gamer has exceeded the maximum balance. A balance exceeding the maximum amount may be transferred to a payment account in the gamer's name.

6.3 The information you need to deposit money into the gamer account is provided on the gaming platform. The payment methods available can be changed from time to time. It is the gamer's own responsibility to keep abreast of any changes in the payment methods. A minimum amount of CHF 10.00 applies to deposits.

6.4 Use of a credit or debit card to make a deposit is subject to an authorisation procedure. If the transaction is allowed and authorised, the deposit amount is credited to the gamer's account. If the card issuer does not allow or authorise the transaction, no amount is credited to the gamer's account.

6.5 If the gamer uses a credit card, the name of the card holder must match the name entered when registering on the page. If this is not the case, the gamer account will be de-activated. The use of a credit card can incur fees charged directly to the gamer via the credit card.

6.6 The balance in the gamer's account is not interest-bearing and there is no way to overdraw the gamer's account. Moreover, the Casino does not grant credit.

6.7 The gamer may only deposit funds of which he is the beneficial owner. He must not deposit money into his gamer's account, which he knows or must assume originates from criminal or illegal activities. Nor is he allowed to make a deposit with funds that he is not entitled to dispose of.

7 Payouts from the gamers account

7.1 The gamer can request at any time that the balance of his gamer's account or a part thereof be transferred to his payment account.

7.2 According to article 50 (2) VGS, winnings and gamer account balances may only be transferred to a payment account in the name of the gamer account holder. Payments may be made with a time delay due to the identity verification process pursuant to art. 15 -17 MLO-FBC.

7.3 According to art. 45 BGS, gamers under the required minimum age and permanently or temporarily banned gamers are not entitled to a refund of their deposits or to a winnings payout. In such case, the deposits remain with the Casino, while any winnings are allocated to the old-age, survivors' and disability insurance (AHV) (art. 45 BGS).

7.4 Unlawful gaming wins are not paid to the gamer, but to the AHV (art. 56 BGS).

7.5 It is the sole responsibility of the gamer to record and report relevant taxes on winnings.

8 Withdrawal

8.1 Please note that any positive balance you might have will be saved and available at the next session.

8.2 Although we always aim to expedite withdrawal as quickly as possible, please take note of the following factors that might influence the time frame in which your payment is processed.

8.3 The withdrawal process starts immediately after a player requests a withdrawal. The player has the option to reverse all or part of a withdrawal request within 24 hours of the request ("Reversal Period"), so that it is not needed to make another deposit. The player has the option of contacting us by chat to have some or all of his credit immediately paid out. 7 Melons reserves the right to refuse your cancellation request at any time and at its own discretion. For your convenience, requested withdrawals initiated between 05h00 GMT on Thursday mornings, and 05h00 GMT Sunday morning will remain in your account available for reversal, until after 05h00 GMT Monday morning. Withdrawals will only be sent to our processing department once the reverse withdrawal period has elapsed.

8.4 We not only abide by the Financial Action Task Force on Money Laundering, but for your protection we also apply strict security measures to ensure that you are the rightful recipient of your funds. In the case of a withdrawal being made for the first time, a large withdrawal or changes being made to payment options, we may take additional security measures to ensure that you are the rightful recipient of the funds. In these instances, copies of identification documents may be required before payment can be made. These measures are in place to protect your money and your privacy and may result in a slight delay.

8.5 Please ensure that all details provided for your withdrawal as well as your account are correct. The Casino will not be liable for any incorrect payments made as a result of incomplete, incorrect or fraudulent details. Charges, An administrative fee of CHF 2 will be levied on any payments below CHF 50, which will be deducted from your cash-in balance prior to payment.

9 Closure of the gamers account

9.1 A gamer account which has not recorded a login or logout for more than 2 years will be closed by the Casino (art. 51 VGS).

9.2 If the gamer no longer lives in Switzerland, or if he is affected by a temporary or permanent game ban, the Casino is legally required to prohibit the gamer to play on the account.

9.3 The gamer can also cancel or close his gamer account at any time. Termination or closure is only possible via the customer service.

9.4 If the gamer's account is closed, any balance pursuant to art. 51 VGS will be transferred to a payment account in the name of the holder of the gamer's account.

9.5 If the gamer's account details are not valid and the Casino is unable to contact the gamer despite efforts bearing a reasonable and proportionate relationship to the amount, the Casino will hold the gamer's funds for two years. After this period, the balance will be transferred to the AHV compensation fund (art. 51 VGS). Any claims against the Casino are completely forfeited therewith.

10 Suspension of the gamers account by the Casino

10.1 The Casino is entitled to block the gamer's account at any time without stating reasons (art. 53 BGS). Any balance that is in the gamer's account at the time of a suspension will be transferred to a bank account in the gamer's name.

10.2 The Casino is also entitled to suspend the gamer's account if there are reasonable grounds to suspect that the gamer is misusing the gaming platform, is involved in money laundering, the financing of terrorism or similar acts or events, or that the funds deposited are of criminal origin or come from a criminal organisation, or if the gamer provides false information.

10.3 Misuse within the meaning of these GTC occurs, for example, when the gamer places bots or bugs in the software, uses other harmful software or other forms of artificial intelligence, regardless of whether the outcome of an online game was changed or influenced by this.

10.4 The Casino has the right, in addition to suspending the gamer's account:

  • to prevent any disputed funds from being paid out to the gamer, whether they be deposits, refunds, bonuses, free money, casino credits, withdrawals or the like; and/or
  • to determine which criteria the gamers must fulfil in order to open a new gamer account at the Casino;
  • to take further legal action.

11 Responsible Gaming

11.1 The Casino takes its tasks and responsibilities seriously in the area of gamer protection and addiction prevention and provides various tools and information to control or limit problematic gaming behaviour on its website at https://www.7melons.ch/en/responsible-gaming/.

11.2 The Casino is obliged to issue an access ban in respect of gamers pursuant to art. 80 BGS if it suspects that the gamer is over-indebted, falls short of fulfilling his financial obligations or participates in games that do not bear a proportionate relationship to his income and assets, or if it receives a corresponding notice from a relevant authority or specialised body (art. 80 (5) BGS).

11.3 The Casino may at any time request the gamer to provide the information and documents required to fulfil its legal obligations, particularly regarding his financial situation. Furthermore, it is legally entitled and obliged to analyse the gamer's transaction data and usage data.

11.4 The gamer may also choose, in accordance with art. 89 VGS, to temporarily withdraw from one or more categories of games or from all of the games offered by the organiser.

11.5 The gamer cannot change the duration of the temporary access ban before it expires. Based on a justified request, the organiser may cancel the temporary access ban if it has been established that the conditions for an access ban pursuant to Article 80 BGS are not met.

11.6 The game ban and prohibition to play is entered in a Swiss national register.

12 Combating Money Laundering

12.1 The Casino is obliged under strict money laundering laws to notify the federal or local authorities in this jurisdiction if it knows, suspects or has reason to believe that a gamer's transaction involves, among other things, money from illegal activities, or that it is intended to conceal money from illegal activities, or to use the Casino to conceal criminal activities.

12.2 To comply with anti-money laundering requirements, payment transactions (deposits and payouts) are checked to prevent money laundering or other types of fraudulent and/or criminal activity. The gamer is also obliged, at the request of the Casino, to disclose the beneficial owner, detailed information and documents concerning payment transactions and the origin of funds in connection with the gamer's account (AMLO-ESBK).

12.3 If the Casino has any knowledge or suspicion that the gamer intends to carry out any of these acts, the Casino is entitled or obliged to take the following action:

  • Immediately suspend the gamer's account and/or refuse to reimburse funds from the gamer's account to the gamer, at its own discretion; and/or
  • Transfer all relevant information about the gamer to an internal database that records such irregularities;
  • Refuse to take deposits or to make pay-outs and request additional verification requests and/or documents, such as, for example but not limited to the origin of the funds paid, proof of age and any other evidence necessary to verify the identity of the gamer.

13 Bonus Rules

13.1 Marketing

  • The casino can offer the player different offers.
  • For this purpose, the organizer determines the necessary criteria for players.
  • In order to avoid misunderstandings, we kindly ask you to observe the conditions applicable to the respective offer.

13.2 General Free Play Rules

  • Once credited and activated by the player, free spins are valid and can be used at any time.
  • Winners can withdraw from the free spins if they do not wish to use them.

13.3 Weekly lucky draw

  • Players must accumulate at least 10 Loyalty Points in the previous week (e.g. 10 spins in a slot with a stake of CHF 5) to qualify for the weekly lucky draw, which takes place each Monday.
  • Players do not need to make an additional deposit to take advantage of the free spins won in the Weekly Lucky Draw offer.
  • Winnings from free spins are credited in real money and are not subject to any wagering requirement.
  • A player has a maximum of twice a month to be drawn in the raffle and win the free spins.
  • If a player rejects the free spins won, they are forfeited completely.
  • Winners are determined at random.
  • No correspondence will be entered into regarding the lucky draw. Legal action is excluded.
  • A cash payout, a replacement and an exchange of the free spins are excluded.
  • The casino reserves the right to terminate the offer without prior notice. Free spins already received remain valid.
  • The casino has the right to exclude players from the offer due to social protection.

13.4 Birthday offer

  • To qualify for the birthday offer, customers must have made at least one deposit before their birthday.
  • An additional deposit on your birthday is not required to qualify for the birthday offer.
  • Winnings from free spins are credited in real money and are not subject to turnover condition.
  • A cash payment, a replacement as well as an exchange of the free spins are excluded.
  • If a player refuses the free spins received, they are forfeited completely.
  • If the free spins are not activated by the player within 7 days, they are forfeited.
  • The casino reserves the right to terminate the offer without prior notice. Free spins received will remain valid until their normal expiry date (7 days after receipt).
  • The casino reserves the right to exclude players from the offer due to social security issues.

13.5 Loyalty Program

  • The loyalty program allows the player to collect loyalty points. Loyalty points can be converted into real money. For every 5000 points the player receives a real money balance of CHF 5.
  • On the first deposit the player receives 2500 loyalty points credited to the player account.
  • Loyalty points expire 60 days after receipt if they are not redeemed.

13.6 The Casino reserves the right to cancel or modify bonuses or offers at any time without notice. Promotions that have already been activated remain valid.

13.7 Grand Casino Kursaal Bern AG reserves the right to suspend and close a player’s account, temporarily or permanently, without notice or compensation, in the event of misuse of bonuses, promotions and/or any other offer by the Casino.

14 General Gaming Rules

14.1 In addition to these Rules, Terms and Conditions, Certain Rules of Play shall apply to you and be binding upon you in respect of your participation at the Casino. You hereby agree to be bound by the aforementioned Rules of Play as if they were specifically incorporated into these Rules, Terms and Conditions.

  • Detailed instructions on how to play the games are published in a suitable and clearly visible location.
  • When a player has self-excluded themselves from gambling, winnings may be transferred to the player upon active request to our Customer Service

14.2 The gamer could be eligible for daily promotions such as  free games , loyalty point`s etc.

14.3 The Casino reserve the right to reclaim all promotions awarded and any winnings accrued if Players are found to be tampering with or abusing any aspect of a casino promotion. Where there is evidence of a series of bets placed by a Player or group of Players, which due to enhanced payments through promotional offers results in guaranteed Player profits irrespective of the outcome, we reserve the right to ignore the bonus element of such offers and settle bets at the correct odds. We further reserve the right to ask any Player to provide sufficient documentation for us to be satisfied in our absolute discretion as to the Player's identity prior to us crediting any promotion, free bet or offer to their account.

14.4 The Casino is not liable for any downtime, server disruptions, lagging, or any technical or political disturbance to the game play. We are not liable for any acts or omissions made by Your internet service provider or any third party with whom You have contracted to gain access to the server that hosts the Website. Software and Services are provided 'as is' and the Casino makes no warranties or representations, whether express or implied (whether by law, statute or otherwise) including but not limited to implied warranties and conditions of merchantability, satisfactory quality, fitness for a particular purpose, completeness or accuracy of the Software/Services or infringement of applicable laws and regulations. The entire risk of as to the use, quality and performance of the Software/Services relies on You.

14.5 We shall not be liable for computer malfunctions, failure of telecommunications service or Internet connections nor attempts by you to participate in games by methods, means or ways not intended by us. You are solely responsible for any telecommunications devices and services utilized by you to participate at the Casino.

14.6 In the event of a Casino system malfunction all wagers are void. Refunds may be given solely at the discretion of Casino Management. Where a manifest error, mistake or system failure results in an incorrect odd, line or handicap taken in a bet, the bet, or that part of the bet if it is a multiple bet/parlay will be null and void.

15 Data Protection

15.1 The Casino processes the gamer's personal data, in particular to submit to him gaming offers, to satisfy its legal obligations and for marketing purposes. Personal data may also be used, inter alia, to send notifications to the gamer via email, SMS, post or telephone. 15.2 The Casino processes the gamer's personal data to provide him with customised information relating to the offers and services for marketing purposes, unless the gamer objects to this. The Casino also sends the gamer promotional information by email if he disclosed his email address on registration and did not object to receiving promotional emails.

15.3 If the gamer does not wish to receive promotional information, he can write to the contact address specified in Section 3 of the Privacy Policy or to the customer service. Each promotional email contains an unsubscribe link which the gamer can use to stop the Casino sending him promotional emails.

15.4 For security reasons, the Casino sends email notifications to the gamer in the event of unsuccessful login attempts. After two unsuccessful notifications, the gamer account is suspended for security reasons.

16 Warranty and Liability

16.1 The Casino cannot guarantee that the games and services on offer can always be used with no malfunctions. The Casino nonetheless remedies all reported malfunctions as promptly as possible. Malfunctions should immediately be notified to the customer service by email or in writing.

16.2 The Casino is not liable for any downtime, server failures, delays or technical malfunctions during the game. In particular, the Casino is not liable for any acts or omissions of the Internet Service Provider or any third party with which the gamer has agreed to access the server on which the website is located.

16.3 In addition, the Casino is not liable for transmission errors or technical problems relating to payment methods. The provisions agreed between the gamer and his payment agent will apply.

16.4 The Casino is only liable for direct damage caused to the gamer by intent or gross negligence. Any further liability is excluded to the extent permitted by law. Liability is expressly excluded for indirect, slight negligence or consequential damage (especially lost profits, loss of data due to interruptions in the Casino's operational availability). Furthermore, the Casino is not liable for contents of third parties that are linked to its website.

17 Intellectual Property

17.1 All copyrights, trademarks and other intellectual property rights to all materials or content provided as part of the Casino website and software remain with it or its licensors at all times. Any use thereof is only permitted within the limits expressly provided by it or its licensors.

17.2 The materials and contents on the Casino website are only made available to the gamer for personal, non-commercial use and may only be downloaded to a single computer hard drive for such purposes. Any other use of these materials and contents is strictly prohibited and infringes the rights of the Casino or its licensors.

18 Final Provisions

18.1 If any individual provision of these GTC be invalid or legally unenforceable now or in the future, the remaining provisions will remain valid. However, the Parties will replace the invalid or legally unenforceable provision with a valid and legally enforceable provision that approximates as closely as possible the spirit and purpose of the original provision.

19 Applicable law and jurisdiction

19.1 These GTCs are governed by Swiss law. The place of jurisdiction is Bern.

20 Translations

20.1 In the event of any differences between the different language versions of these GTC, the German version will prevail.

20.2 These Rules, Terms and Conditions may be translated into many different languages. If there is any discrepancy between the German language version of these Rules, Terms and Conditions and any other language- version of these Rules, Terms and Conditions in the meaning and interpretation of any of the provisions of these Rules, Terms and Conditions, the meaning and interpretation of the provisions under the German language version shall prevail.
